Do I need a car accident lawyer if I only suffered a minor injury?

The law is confusing with respect to what a minor injury is. It is best to take advantage of a free consultation with Trevor to get advice on what types of damages you may be entitled to. Recently, we were retained by a young mother who had seemingly only suffered a minor whiplash in a parking lot sideswipe accident. Upon further questioning and review of the evidence, we were able to show that she suffered from a mild concussion or brain injury. Our client received a settlement in excess of $100,000.

Will I have to pay legal fees if my car accident injury case goes to court?

Trevor takes your car accident injury case on a contingency fee basis. This means that you will only pay a fee when you receive a settlement or judgment. The fee is calculated based on a percentage of the settlement. Although most cases are settled out of court, if your case proceeds to trial, you only pay a fee if you win.  

Will a car accident lawyer pay the cost of disbursements?

Can I still claim for injuries if I was charged by police?

The police have the discretion to lay charges at a motor vehicle accident scene. They consider factors such as the placement of vehicles, witness statements, traffic lights, traffic signs, etc.. The fact that you were charged, or even convicted, of a traffic offence does not prevent you from bringing a civil action for injuries. All of the evidence will be considered. You must prove on the balance of probabilities that the other driver was responsible for the accident. If there is evidence that you were partly to blame, your damages can be reduced accordingly. For example, if you were 50% to blame you may only recover 50% of your damages.

What if I was injured as a passenger in a car driven by a friend or family member?

If you have suffered injuries as a result of negligent driving, you are entitled to make a claim. Some people are hesitant to claim against a friend or family member because they feel it is morally wrong. When insurance companies determine what to charge for car insurance they factor in the risk of a passenger being injured in your car. They don’t exclude friends and family members. That means your friends and family members have been paying car insurance for a long time based partly on the risk that you might be hurt riding as a passenger in their car. If you decide not to make a claim against a friend or family member for that reason you are only benefitting the insurance company.

How much time do I have to file a lawsuit in a car accident injury case?

In Calgary, per the Limitations Act of Alberta, car accident injury claims must be filed at the Court within two years from the date of the accident. Failure to file in time will result in the loss of your right to make a claim. There are exceptions in the cases of minors and persons under disability.
